To register, the User must fill out a form and provide the requested personal data, according to our Privacy Policy. Once the registration is complete, a personal account will be generated for the User, which can be used to access the services of the Cannabis Libre Club website and social media platforms.

El Milagro Verde S.A.C.'s services allow the User to purchase products or hire support services for the management of acquiring medical cannabis products offered by Soluciones Farmacéuticas S.A.C. – SOLFAR, through the Cannabis Libre Club website and social media platforms, as well as request home delivery services.

By browsing, using, and/or making a purchase, whether without registering or after completing registration, the User accepts, without reservation, all the provisions included in these Terms and Conditions, as well as those established by Soluciones Farmacéuticas S.A.C. – SOLFAR, that regulate access and use of the Cannabis Libre Club website and social media platforms for both registered and non-registered Users.

Users utilizing this platform acknowledge that the services offered through the Cannabis Libre Club website and social media platforms are exclusive to those channels and are not applicable to other sales channels and/or media, nor to wholesale or corporate sales.

The support service for acquiring medical cannabis products offered by Soluciones Farmacéuticas S.A.C. – SOLFAR provides an alternative where Users designate a representative to manage the entire process of obtaining medical cannabis products. This includes coordinating a medical consultation, processing the product’s dispensing, and arranging its delivery, all in accordance with the specific case and applicable regulations.. These medical cannabis products are manufactured and dispensed by Soluciones Farmacéuticas S.A.C. - SOLFAR, who, under their own responsibility, provide information about their products and sell them to Users.

The User who hires the support service for the acquisition of medical cannabis products offered by Soluciones Farmacéuticas S.A.C. – SOLFAR can receive their medical cannabis products at the address indicated for this purpose, as long as the requirements set forth in these Terms and Conditions are met. The personnel assigned as a representative will handle the dispensing and delivery process of the medical cannabis product to the User. Additionally, the personnel acting as a representative are prohibited from accepting tips and/or gratuities.

El Milagro Verde S.A.C. does not own the products acquired through the hiring of a support service for the acquisition of medical cannabis products. Therefore, (i) it does not possess them, (ii) it does not offer them for direct sale to consumers, (iii) it does not determine offers or promotions, and (iv) it does not intervene in the perfection of transactions between suppliers and users.

Soluciones Farmacéuticas S.A.C. - SOLFAR will make specific indications, as the case may be, about the origin of the acquired medical cannabis products that require it, in the support service. El Milagro Verde S.A.C. is not responsible for providing this service to the User. Additionally, any coordination related to this indication must be made directly with Soluciones Farmacéuticas S.A.C. - SOLFAR. El Milagro Verde S.A.C. will not be responsible for timely and accurate indications, as it is the responsibility of Soluciones Farmacéuticas S.A.C. - SOLFAR to address any non-compliance or inaccurate indication.

El Milagro Verde S.A.C. only makes available a digital platform for Soluciones Farmacéuticas S.A.C. - SOLFAR to offer its products alongside its own, and after the validation of the purchase order, Soluciones Farmacéuticas S.A.C. - SOLFAR is responsible for fulfilling the characteristics and specifications offered to the User, as well as all requirements for the proper commercialization and marketing of their products. In such cases, the user's personal data will be shared with Soluciones Farmacéuticas S.A.C. - SOLFAR only for the purpose of issuing the payment receipt, which they issue directly.

El Milagro Verde S.A.C.'s role is limited to: (i) providing users access to the virtual support platform, (ii) collecting and forwarding payments made for product acquisition, and (iii) fulfilling any other obligations expressly stated for El Milagro Verde S.A.C. in these Terms and Conditions.

El Milagro Verde S.A.C. does not guarantee the proper functioning and/or suitability of the medical cannabis products sold by Soluciones Farmacéuticas S.A.C. – SOLFAR, nor does it assume any responsibility for any potential damage or harm caused by the use of products offered by Soluciones Farmacéuticas S.A.C. - SOLFAR.

2.1. Validity, Price, and Stock of Medical Cannabis Products

The User understands that it is the sole responsibility of Soluciones Farmacéuticas S.A.C. - SOLFAR to keep the information on the website updated regarding the products that can be acquired through our virtual support platform.

As such, El Milagro Verde S.A.C. is not responsible for any (i) errors, (ii) omissions, or (iii) lack of updates on the website made available by Soluciones Farmacéuticas S.A.C. - SOLFAR for the sale of their products, concerning prices, validity of offers, and/or product stock.

The services of El Milagro Verde S.A.C. are available in some areas of Lima Metropolitana and other provinces within Peru, which can be consulted at: https://www.cannabislibre.club/pe/1-envio-y-entrega#zonas-de-cobertura-y-costos, and only to those who are legally able to enter binding contracts as stipulated by the applicable law. By accessing the Cannabis Libre Club website and social media platforms, the User declares they are over 18 years of age and capable of assuming binding obligations with respect to any liability that may arise from the use of El Milagro Verde S.A.C.’s services. Actions taken by minors on the Cannabis Libre Club website and social media platforms will be the responsibility of their parents, guardians, or caregivers.

The User agrees to use the services of El Milagro Verde S.A.C. in accordance with the law, these Terms and Conditions, morality, good customs, and public order. Accordingly, the User agrees to use the Cannabis Libre Club website and social media platforms following these directives:

  1. The User agrees not to use the Cannabis Libre Club website or social media platforms for illegal purposes or purposes contrary to the content of these Terms and Conditions, damaging the interests or rights of third parties, or in any way that could harm, disable, deteriorate the platform, or prevent other Users from normally enjoying the services of El Milagro Verde S.A.C.
  2. The User expressly agrees not to destroy, alter, disable, or in any other way damage the data, programs, or electronic documents found on the Cannabis Libre Club website or social media platforms.
  3. The User agrees not to obstruct access to other Users by consuming massive amounts of computer resources through which El Milagro Verde S.A.C. provides its services, as well as not to carry out actions that damage, interrupt, or generate errors in the Cannabis Libre Club website or social media platforms.
  4. The User agrees not to attempt to penetrate or test the vulnerability of any system or network of El Milagro Verde S.A.C., nor to break the security or authentication measures.

El Milagro Verde S.A.C. reserves the right to determine, at its sole discretion, when any of the obligations listed above have been violated.

In the event that a User violates the provisions of this section, El Milagro Verde S.A.C. may take one of the following actions, depending on the severity or recurrence of the violation: (i) temporary suspension of the User’s account, (ii) permanent cancellation of the User’s account, or (iii) legal actions for civil or criminal liabilities.

For Users with an account: Upon registration, the User declares that the provided data is their own, meaning they should not include another person’s name or provide any personal information belonging to others with the intent to impersonate them. In such cases, El Milagro Verde S.A.C. reserves the right to take appropriate measures if the User attempts to impersonate someone else, as detailed in point 2 of this document.

Users who successfully complete their registration will be given a personal account with a password, which they can use to access the Cannabis Libre Club website. Each User is responsible for their own password and must keep it strictly confidential, never revealing or sharing it with third parties. Any action performed through a User’s personal account is presumed to have been carried out by the owner of the account.

If a User identifies that a third party knows and is using their password and personal account, they must immediately notify El Milagro Verde S.A.C.

El Milagro Verde S.A.C. will not be responsible for any damage related to the disclosure of a User’s name or password, or for the use of a User’s name or account that is not attributable to the company, and which results from the User’s actions.

El Milagro Verde S.A.C. may take any necessary actions when it deems that an account is no longer secure. Such actions may include the cancellation or termination of the account. An account may be considered insecure when it is linked to:

  1. Reported and/or denounced fraudulent transactions.
  2. Wholesale purchases (violation of point 9 of this document).
  3. Use of associated benefits (created exclusively for such use).
  4. Misuse of benefits directly.
  5. Complaints or allegations regarding the name of a User that violates third-party rights, such as requesting a name or password change.
  6. Any other reason arising from obvious misuse of the account.

Communications regarding the administration or inquiries related to data and passwords of a specific account can be sent to: hola@cannabislibre.club 

All intellectual property rights of the Cannabis Libre Club website and social media platforms, their content, and designs belong to El Milagro Verde S.A.C. or, where applicable, to linked companies and/or third parties. In cases where the rights belong to third parties, El Milagro Verde S.A.C. has the necessary licenses or permissions for their use.

The reproduction, distribution, transformation, public communication, making available, or any use of all or part of the content of the Cannabis Libre Club website or social media platforms is expressly prohibited without the authorization of El Milagro Verde S.A.C. The User agrees to respect the intellectual property rights belonging to El Milagro Verde S.A.C., linked companies, and third parties.

The use or reproduction of any registered trademark, name, or logo displayed on the Cannabis Libre Club website and social media platforms is also expressly prohibited without the prior written consent of El Milagro Verde S.A.C.

Additionally, the following practices are also prohibited:

  1. Presenting a page from El Milagro Verde S.A.C.’s services within a window that does not belong to El Milagro Verde S.A.C., using the "framing" technique.
  2. Inserting an image published on the Cannabis Libre Club website and social media platforms on a page that does not belong to El Milagro Verde S.A.C. using the "in line linking" technique.

El Milagro Verde S.A.C. grants the User a personal, free, non-transferable, non-exclusive, and revocable license for the software of the Cannabis Libre Club website, so the User can use El Milagro Verde S.A.C.’s services. Additionally, improvements may be automatically updated, depending on the User’s device, requiring the User’s consent where applicable. El Milagro Verde S.A.C. is not responsible in this regard. The User cannot modify, alter, manipulate, or reverse-engineer El Milagro Verde S.A.C.’s software. 

In the event that links or hyperlinks to other websites are provided on the Cannabis Libre Club website or social media platforms, El Milagro Verde S.A.C. declares that it does not exercise any control over such sites and content. Under no circumstances will El Milagro Verde S.A.C. assume responsibility for the contents of any link belonging to an external website or social media platform, nor guarantee the technical availability, quality, reliability, accuracy, truthfulness, validity, and legality of any material or information contained in those hyperlinks or other internet locations.

El Milagro Verde S.A.C. states that the suspension or interruption of the website does not cause any harm to the User, and there is no legal obligation to maintain a permanently operational website. Nonetheless, through this clause, the User acknowledges that El Milagro Verde S.A.C. is not responsible for any possible damage or harm to the Cannabis Libre Club website or social media platforms that may result from events beyond El Milagro Verde S.A.C.’s control, such as unlawful intrusions.

Similarly, the Cannabis Libre Club website or app will provide a search engine that allows the User to find the products and services they wish to purchase. The search engine will not, under any circumstances, provide recommendations from El Milagro Verde S.A.C. or replace the opinion of a doctor. It is the User’s responsibility to review the main warnings and/or precautions for the use of the products and services.

The User of the Cannabis Libre Club website and social media platforms can place a maximum of three (03) orders per day, respecting the maximum purchase limits in each category:

• Products offered by El Milagro Verde S.A.C. (over-the-counter):

  • Accessories - maximum of 8 units.
  • Devices - maximum of 2 units.
  • Tools - maximum of 2 units.

• Products offered by Soluciones Farmacéuticas S.A.C. – SOLFAR (prescription only):

  • Medical cannabis products - The Cannabis Libre Club website and social media will allow the User to request a medical prescription for making purchases. The expression "Includes Prescription" indicates that the medication is sold exclusively under a medical prescription. By purchasing one or more products under this condition, the User expressly acknowledges and accepts that they are requesting the management of a medical consultation for this purchase and must present the medical prescription at the time of product delivery. The purchase limit for medical cannabis products with a prescription will be up to 5 units; however, the maximum quantity dispensed and delivered will be as indicated by the prescription. The User must present the medical prescription before receiving the order; otherwise, delivery cannot be completed.

Users have the option to make online payments via "Mercado Pago" to pay for their orders without additional costs using:

  • Credit cards.
  • • Debit cards.
  • Bank transfers.
  • Yape.
  • Cash payments.

The accepted credit and debit cards are:

      • Visa
      • MasterCard
      • American Express

No closed-loop cards (those that do not have the Visa, MasterCard, or American Express logo) will be accepted. After the User has confirmed the order, it is their responsibility to ensure that the selected payment method is available during the purchase process. If the User does not have the indicated payment method, the order cannot be fulfilled.

Products and services offered on the Cannabis Libre Club website or social media platforms, unless otherwise specified for specific cases or product/service offers, can only be paid for using the methods indicated for each case. The use of credit or debit cards is subject to the terms set out in these Terms and Conditions and also those related to the issuing entity, as outlined in the respective contracts with the issuing bank and the fintech company “Mercado Pago.”

In the event of any conflict, the provisions of the latter contract will prevail. For bank cards accepted on the Cannabis Libre Club website or social media platforms, aspects such as issuance date, expiration, blocks, commission fees, installment interest charges, etc., will be governed by the respective contracts with the issuing bank, and El Milagro Verde S.A.C. will not be held responsible for any of these aspects.

When using a credit or debit card, the cardholder's name must match the name used during registration on the El Milagro Verde S.A.C. platform. Otherwise, the transaction may be canceled. In case of suspicion or confirmation of unauthorized purchases, El Milagro Verde S.A.C. will cancel the purchase and void the transaction.

The receipt issued for the User’s order will be a "Boleta de Venta".

El Milagro Verde S.A.C. is responsible for the ongoing update and review of the products and services displayed on the site; however, it reserves the right to modify or discontinue products or services at any time without harming the User.

Both the Cannabis Libre Club website and social media platforms are pre-configured to show only those products and services available at the time of the User's browsing.

Nevertheless, according to the provisions of Clause 12, El Milagro Verde S.A.C. reserves the right not to approve a purchase or service request, and therefore not fulfill an order if the requested stock is not available due to any exceptional circumstance. All purchase or service requests made through the Cannabis Libre Club website or social media platforms will be validated based on product and service stock, user data, payment method information, and management capacity. If any of these validations fail, the purchase or service request will not be fulfilled, and the User will be notified of the rejection via the phone number and email address provided during registration.

Through the Cannabis Libre Club website or social media platforms, offers for products and services will be made, which may be accepted via electronic confirmation using the mechanisms offered by the Cannabis Libre Club website or social media platforms. All offer acceptance will be subject to the condition that El Milagro Verde S.A.C. validates the transaction. El Milagro Verde S.A.C.'s receipt of a purchase or service order does not imply that it has been accepted, validated, or that the availability of the products or services has been confirmed. Consequently, for any operation carried out on the Cannabis Libre Club website or social media platforms, confirmation and validation or verification by El Milagro Verde S.A.C. will be an essential requirement for the execution of the contract.

To validate the transaction, El Milagro Verde S.A.C. will verify: a) that there is available stock of the products or services when the offer is accepted; b) that the chosen payment method is validated and accepted; c) that the data provided by the User matches the data submitted during the purchase or service request; d) that the payment has been credited by the User; and, e) that there is management capacity to perform the delivery (the "Purchase Conditions"). This validation must comply with the “minimum or maximum daily purchase limits” (depending on the product category), in line with Clause 8 of these Terms and Conditions. It is important that the User stays alert for any communication, as El Milagro Verde S.A.C. may contact the User for the aforementioned validation. Following the provisions of the previous paragraphs, and as a security measure for requests and transactions, El Milagro Verde S.A.C. may void purchase or service orders if it finds that one or more Purchase Conditions are not met, particularly those outlined in items a, b, c, d, and e above. If any of these conditions are not met, El Milagro Verde S.A.C. will automatically cancel the order, notify the financial institution that issued the payment card within seven (7) business days, and the issuing bank will be responsible for releasing the retained funds according to its procedures and policies. El Milagro Verde S.A.C. may proceed to cancel any order and void the corresponding purchase or service order, under the terms outlined in the previous paragraph, at any time, even after the User has received confirmation of receipt of the purchase or service order. Additionally, product or service availability cannot be confirmed until the order has been validated, considering any discrepancies between the availability shown on the website or social media platforms and the actual stock of products and services. Similarly, if the purchase or service request is not approved, El Milagro Verde S.A.C. will send a notification (via email and telephone) to inform the User.  

The prices of products and services available on the Cannabis Libre Club website or social media platforms will only be valid and applicable on those platforms and will not apply to other sales channels used by El Milagro Verde S.A.C. and/or its affiliated companies, such as other online sales sites, catalogs, pharmacies, or others. The prices of products and services offered on the Cannabis Libre Club website or social media platforms are stated in Peruvian Soles. These prices include only the value of the product or service offered. These prices include the General Sales Tax (IGV) and do not include transportation, handling, shipping costs, accessories not expressly described, or any additional item or bank interest charges generated by the chosen payment method. The prices of certain products or services offered on the Cannabis Libre Club website or social media platforms may reflect a typing error (incorrect price), so in cases where the purchase appears to have been made and the correct price is higher than the one listed on the website or social media platforms, El Milagro Verde S.A.C. will send an email and telephone communication to the User to inform them, allowing the User to confirm the correct price. If contact is not possible, or if confirmation of the correct price is not obtained within 24 hours of the communication, the order will be canceled, and the User will be notified via email and phone.

The User may choose to have their order delivered to the address they specify for this purpose, provided that the requirements specified in this document are met.

The validity period of an offer is the one that coincides with the expiration date indicated in the promotion or by the exhaustion of the quantities of products or services (stock) available for that promotion, duly informed to the User, or as long as the offer of the service remains published and available, whichever comes first.

The promotions offered on the Cannabis Libre Club website or social media platforms are not necessarily the same as those offered through other sales channels used by El Milagro Verde S.A.C., unless expressly stated on the Cannabis Libre Club website or social media platforms or in the advertising for each promotion. When the Cannabis Libre Club website or social media platforms offer promotions consisting of the free or reduced-price delivery of a product with the purchase of another, the product delivered for free or at a reduced price will be dispatched to the same location where the purchased product is delivered. The Cannabis Libre Club website and social media platforms subject their promotions and promotional activities to compliance with applicable regulations. The prices of certain promotions offered on the Cannabis Libre Club website or social media platforms may reflect a typing error (incorrect price). In cases where the promotion purchase appears to have been made, and the correct price is higher than the one listed, El Milagro Verde S.A.C. will send an email and telephone communication to the User to inform them, allowing the User to confirm the correct price. If contact is not possible, or if confirmation of the correct price is not obtained within 24 hours of the communication, the order will be canceled, and the User will be notified via email and phone.

The processing of personal data and other User information that El Milagro Verde S.A.C. carries out through the Cannabis Libre Club website and social media platforms, as well as the purposes of such processing, will be detailed specifically in the Privacy Policy.

The User expressly agrees that the telephone number and email address provided in the registration form will be the official means of contact between El Milagro Verde S.A.C. and the User, and it is the User's sole responsibility to ensure that this email address and phone number remain active and functional in order to receive all communications from El Milagro Verde S.A.C.

Messages or communications from El Milagro Verde S.A.C. to Users can only come from official sites or accounts. If it is detected that a User is sending communications or making posts on behalf of El Milagro Verde S.A.C., appropriate corrective and legal actions will be taken to protect other Users from potential confusion.

Additionally, any communication that the User wishes to send to El Milagro Verde S.A.C. or Cannabis Libre Club must be directed to: hola@cannabislibre.club

El Milagro Verde S.A.C. will not be held responsible for any delay or failure in performance or interruption of the Cannabis Libre Club website or social media platforms that may result directly or indirectly from any cause or circumstance beyond its reasonable control, including, but not limited to, failures in electronic or mechanical equipment or communication lines, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labor problems, wars, or government restrictions.

Additionally, El Milagro Verde S.A.C. is always working to ensure the availability and timely delivery of products and services within the offered timeframe; however, we inform all our users that our business activities are subject to compliance with government regulations. These may be affected at any time by cases of force majeure (as stipulated in the previous paragraph and in accordance with the provisions of Article 1315° of the Peruvian Civil Code – Legislative Decree No. 295), in which case we will be entitled to cancel the purchase order and refund the payment made.

In accordance with the provisions of the Consumer Protection and Defense Code, Law No. 29571, El Milagro Verde S.A.C. makes available to Users a virtual Complaint Book so that they can formally record their complaints or claims regarding El Milagro Verde S.A.C.’s services. El Milagro Verde S.A.C. cooperates with competent authorities and third parties to ensure compliance with the law. El Milagro Verde S.A.C. may disclose the personal information of Users of its services upon request from judicial or governmental authorities, to the extent deemed necessary, for investigations carried out by them, especially in the case of criminal or fraud investigations, or those related to computer piracy, copyright violations, intellectual property rights infringements, or other illegal activities that could expose El Milagro Verde S.A.C. or its Users to any legal liability.

Additionally, El Milagro Verde S.A.C. reserves the right to share information about its Users with other Users, entities, or third parties when there are sufficient grounds to believe that a User’s activity is suspected of attempting or committing a crime or attempting to harm others. This right will be used at the sole discretion of El Milagro Verde S.A.C. when it deems it appropriate or necessary to maintain the integrity and security of the Cannabis Libre Club website and social media platforms, to enforce these Terms and Conditions, and to assist in the enforcement of the law. 

Users expressly authorize the assignment of these Terms and Conditions in favor of any person who (i) becomes bound by these Terms and Conditions and/or (ii) becomes the new controller of the database containing the User’s personal information. After the assignment occurs, El Milagro Verde S.A.C. will no longer be responsible for any actions occurring after the date of the assignment. The new responsible party will assume all obligations established in these Terms and Conditions and the Privacy Policy regarding the treatment, safeguarding, and conservation of the User’s personal information.

These Terms and Conditions are governed by Peruvian law, and any dispute arising concerning the validity, application, or interpretation thereof, including the Privacy Policy, shall be resolved in the courts of the Republic of Perú.

The User of the Cannabis Libre Club website and social media may request an exchange, return, or cancellation, adhering to the conditions permitted in each product category:

21.1.     Conditions for Products Offered by El Milagro Verde S.A.C. (Over-the-Counter):

The provisions outlined in this clause 21.1 apply only to cases where the User, despite receiving the product without any issue, wishes to return or exchange it without stating a reason; this is a right of withdrawal that our company voluntarily grants to users based on its guaranteed satisfaction policies, provided that the following conditions are met. These provisions/conditions do not apply to exchanges or returns to which the customer is entitled under the law due to the product being delivered with any issue, and therefore do not exclude or limit the legal rights recognized for consumers.

Exchange/Return Process

To access the possibility of exchanging and/or returning an over-the-counter product purchased, the User must meet the following requirements:

  1. The request must be made within 24 hours of the sale.
  2. The User must have the proof of payment, which must be presented/submitted at the time of the exchange/return.
  3. The product(s) must be verified by personnel assigned by El Milagro Verde S.A.C., as applicable, and must not have been used, consumed, or be damaged or show signs of handling that affect their condition as new. They must be complete, in their original packaging, with labels clearly readable and accessories, if applicable.

If the User meets the above requirements, they have the following options:

  1. Request an exchange of the product for another identical one, provided that El Milagro Verde S.A.C. has stock available; or for a different product of equal value using the already paid amount.
  2. Request a full refund.

Refund of Money

If the User requests a refund, they may choose between:

  1. A reimbursement through the payment method used for the purchase.
  2. In the case of card payments, the time for the refund will depend on the User's banking institution.

Product Exchange

For purchases made through this website or Cannabis Libre Club's social media under the home delivery service, if the User requests a product exchange, El Milagro Verde S.A.C. will handle the collection and exchange of the product/products at the address indicated by the User (at no additional cost to the User if the product was delivered with any issues). It is the User's responsibility to be at the address on the specified date and time. If the User is not present, they must coordinate a new delivery date. The User has the option to reschedule a new date and place a maximum of two (02) times.

Transport Personnel

The transport personnel responsible for collecting the product and delivering the exchange are not authorized under any circumstances to inspect and/or handle the product; their sole function is to collect it and deliver the product exchange. Transport personnel are prohibited from receiving tips.

Cancellation by the User

In the event the User makes an error in the purchase request (error in delivery address, personal data, product quantity, among others), they must cancel the purchase immediately and proceed with a new request.

21.2.     Conditions for Products Offered by Soluciones Farmacéuticas S.A.C. – SOLFAR (Prescription Only):

Notwithstanding the aforementioned, changes or refunds are not accepted for medical cannabis products offered by Soluciones Farmacéuticas S.A.C. – SOLFAR due to the nature of the acquisition of these products.

If the User makes an error in the support service request (error in delivery address, personal data, product quantity, among others), they must cancel or annul the support service request immediately and proceed with a new request if necessary.

El Milagro Verde S.A.C. expressly reserves the right to modify, update, or expand these Terms and Conditions at any time.

Any modification, update, or expansion made to these Terms and Conditions will be immediately published through this medium, and it is the User's responsibility to review the current Terms and Conditions at the time of navigation.

If the User does not agree with the aforementioned modifications, they may choose not to use the Services of El Milagro Verde S.A.C.
